Terms of Use

These conditions govern access to Upshur County Criminal History. Visiting a page, reading its material, or submitting a search means that you accept them. Do not continue to use the website if you disagree with any condition below.

NO FCRA USE. This privately operated website has no affiliation with a local, Texas, or federal government body. Neither the website nor its advertising partners provide a service for credit, employment, tenant, or insurance decisions, or for another purpose regulated by the Fair Credit Reporting Act (FCRA). Its role is to identify public criminal-record channels in Upshur County, Texas. It is not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site with no government connection. It neither stores official criminal records nor obtains records, performs official checks, or files documents for a visitor.

The content identifies the Upshur County Sheriff, local court clerks, Texas Department of Public Safety, and Texas Public Sex Offender Registry as official record channels. Some pages also connect visitors to independently operated search tools.

2. Rules for Using This Site

Use is allowed only if you agree not to:

  • Violate any federal, Texas, or local law
  • Stalk, threaten, or harass a person with information found here
  • Base hiring, housing, lending, or insurance decisions on content from this site
  • Attempt unauthorized access to a system or account
  • Send bots, scrapers, or other automated tools against the pages
  • Interfere with performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

No person may use information from this website or a linked tool to harass, stalk, threaten, intimidate, or discriminate. Such conduct may also violate criminal law. Texas Code of Criminal Procedure Chapter 62 makes registry information available for public safety, not for vigilantism or unlawful action against a person listed in the Texas Public Sex Offender Registry.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA and do not create credit reports, background reports, or consumer reports. The same is true of the service offered here by advertising partners. You agree that data from the website or a linked tool will not be used to:

  • Decide whether to hire or fire someone
  • Screen potential renters or housing applicants
  • Judge creditworthiness or set insurance premiums
  • Determine who qualifies for licenses, permits, or government programs
  • Do anything else that falls under FCRA rules

A lawful FCRA-regulated need must be handled through an authorized official process or a compliant consumer reporting agency, not through this website.

5. No Legal Advice

Website content is general information, not legal advice. It cannot determine how an Upshur County charge, conviction, warrant, expunction, or nondisclosure law applies to a particular person. Ask a licensed Texas attorney for advice on an individual matter.

6. No Warranties

All content and services are provided "as is." We make no promise that:

  • The information here is accurate, complete, or current at any given time
  • The site will stay up and running without interruptions
  • Our pages are free of errors, bugs, or security holes
  • Results from our partner search tools will be thorough or accurate

Criminal records can change after charges, dismissals, sealing, expunction, or later reporting. Gaps and delays can occur. Only the Upshur County or Texas office that holds the source record can provide an official statement.

7. Third-Party Services and Links

Links lead to county offices, court portals, Texas agencies, legal resources, and outside search services. A destination is independent from us. We do not control its availability, content, fees, or data practices and accept no responsibility for them. Read the destination's own terms before using it.

8. Intellectual Property

Upshur County Criminal History or its content partners own the website's text, graphics, logos, and code. You may not copy, alter, distribute, or create derivative material from that content without prior written permission.

9. Limits on Our Liability

To the fullest extent allowed by law, we are not liable for damages arising from website use, including reliance on information obtained here or from a linked service.

10. Indemnification

You agree to hold us harmless from claims, demands, or legal actions arising from your use of the website or violation of these terms, including related costs and legal fees.

11. Governing Law

Texas law governs these terms. Any dispute tied to use of the website must be brought in a court located in Texas. Government record access remains subject to statutes including the Texas Public Information Act, Government Code Chapter 552, and criminal-history dissemination provisions in Government Code Chapter 411.

12. Changes to These Terms

We may revise these terms. A revision takes effect when the new version is posted on this page.

13. Cutting Off Access

We may suspend or end access at any time, for any reason, and without advance notice.

14. Severability

If a court finds one provision invalid or unenforceable, the other provisions remain effective. The affected language will be adjusted only as far as needed for enforcement.

15. Questions

Questions about these conditions may be sent through the Contact page.
